I plan to talk to my lawyer today. My past experience is that lawyers don't give all the options themselves. You have to know what options you have and then they will give advice on that.
So if anybody has gone through similar situation, please give your inputs. I am sure many other people can benefit from this information.

you guys might want to talk to your attorneys. Most of the time attorneys ping with their contact in service centers and get some answers if it is still not receipted.
Most of them have an email id whom they contact and find out normally. I am not sure if service centers are responsive if there are huge amounts of data entry still going on.

I have read on USCIS web site that it is a quarterly report, this strange report do not have a date on it saying when it was generated. If it is a quarterly report I dont understand why they ran it in the middle of a quarter? This report should be run at the end of the quarter. Not in 1600AD what USCIS considers to be 2009.

Sorry to hear this, but what is the violation you are referring to. I thot, L1s can be employed in the US on client projects by consulting companies, big or small. Sorry if i dont understand the visa rules here

Based on the June Bulletin, I will be filing my I485 in June.
Now, I have H1-B(with my current company till Feb'2010 that I just got approved a month back.(not stamped in passport yet)
-- Should I file EAD for myself ( I probably would want to change jobs after 180 days) ? Or is it better to be on H1-B.
-- Should I file AP for both myself and my wife(she is on H4) ?
Also, when I decide to change jobs using AC21 rule, is it better to tranfer
H1-B to a new company or if I have EAD, how does that work ?
Any inputs will be greatly appreciated..!!

Are you sure you have a job, a house and have the capacity to get to work without needing assistance ?
Your simplistic explanation about ARMs Vs length of ownership of the house, decision to 'leave the house' because of a job (whatever that means, did you lose your job or did you find a better job or what ?) is just incredible.
How much down payment did you make ? Won't you lose that amount?

As it has been 85 days since my 485 reached in NSC and updates, so I called the 800-375-3283 and transfered to IO, she was very polite and told that now they are taking 120 days to issue receipts. ( ware...waa...how fast service)
As CAA dude post a 800-246-8253 this is Custom #. (lol)
So they started to say now all we have to wait for another 30 days, there is no other way to get the receipt #, she said call once in a week if u are lucky, u may get ur receipt #,
yes sending fax, e-mails, create a query this make sence to invistigate the pending application.
Ok again ur count down starts against 120 days..........

My receipt date is June 20 and my PD is Oct 2002. If the July visa bulletin does retrogress, will I still be affected with regards to I-765?

Got RFE (sept 10, 2010). was working on RFE (medical report needed)..
Today I spent around $300 to start medical exam report. I've to still to do lab work and may need x-ray. I was working with my swollen arm and got this message..

After 2 failed marriages (i mean with 2 different companies)...some risk-taking ..coz, i left my second employer after crossing 200 days since filing I-485 , Used EAD and took up full-time employment with an awesome organization , and then later 2nd employer revoking I-140 that lead to an RFE ...and USCIS keeping the status Response received since Jan 2009 ...and now this ...after opening an SR on 08/10..Looks like it took an exact week since the SR was created.
Of course, my roller-coaster was a small one compared to the rest of the friends in this forum.. Good luck to all and thanks to one and everyone.

But there is a possibility that EB2I has not yet retrogressed (inspite of heavy porting) because USCIS knows EB1C 12000 will flow to EB2 right. In that case we may not see movement of dates in par with 12000 spillover.
Maybe I am pessimistic.
In all calculations, it is mentioned that porting at max could be 6k/year. How did we come up with this number? Any proof or just a guess?

This is a very simple calculation. Following are the numbers before Oct -2006. These total to ~ 12K.
EB2-C - 3521
EB2-I - 9345
The dates will move further if more than 12K numbers are infused into the system. I would say that the dates should be in Oct - Nov 2006 range with these 12K numbers, having Nov as buffer as they may issue RFE's to folks.

For the cases mentioned in this thread, employers have flatly refused to consider anybody on EAD. So the clause of preference to US citizens does not apply. The you posted is the original text and does not include amendments or changes.

I was asking for Ideas.. it is not just Kumar or some more people giving an idea that one should leave the house if the value of the house has gone down and now you have to move because of ur job and it is hard selling ur house where u may have to bear a loss ..
I already had conversation with american people ( not any desi's) in my office and they also had the same opinion as to leave a house if u have to leave because of job..
U tell me how wise it is to give a loan to a person without a down payment..The reason i said that other people are stupid is because.. i took an ARM loan of 5 years,, where i knew that i am not going to live in the house for more than 3 years and will later sell it..and there are people who knew that they are going to stay in the same house for more than their ARM period.. but didnt realize that they wont be able to make payment once the rate is re-adjusted.. i am calling those people's decision as stupid..
about me making a bad decision about buying a house.. well not 2 years ago..
i can sell the house for a loss of may be 20,000.. but why should i pay that money from my pocket.. i can keep that in my savings account and use it in my bad time..

Consider the impact of foreclosure, bad credit will mean you will not get any loan. It will be tough to get auto or any other credit. You carry risk with background checks. I think the lending standards will get tough going forward which means you don't know for how long you will not qualify for home. In my opinion, if you have 20k and it is matter of losing some savings, not going to foreclosure looks better option.

Called the DOS. Told them I need to travel to my home country and asked them if they can verify if my information is in PIMS. She asked if the H1-B is an extension case which it is. She said the extension cases are taking a bit longer than the new ones. That is quite surprising. Finally she looked in the database or whatever and said they do not have my extension information yet. All they have is the information from the expired petition. No timelines just asked me to call back in a week.:rolleyes:
