    My I-485 case is current right now. If I change my employer(whoever sponsored Green Card) to a new employer, what are the concequences? I want to do H1B transfer because I am not using EAD right now, should I file AC21 or not?

    Contacting Senator seems to be the best option apart from POJ method..if there is some discrepancy from Service Request Response, you can clear that up from POJ method.
    That said, even I am waiting for GC approval and needless to say, this wait is more frustrating than the wait before PD was current.

    Today got this response from service request.

    Overcome your fears, If you don't ask answer is no. No one before July 2007 thought that dates will become current for all categories but it did happened.

    To me it seems a genuine demand, We need to bring this arguement/demand forward in very rational way keeping emotions aside.

    Remember, This is in addition to whatever we are doing to expedite the GC.

    Upto GC, it is fine to do any movement/lead..perfectly acceptable.
    But do not waste energy and aggressivness on citizenship related things. It rather damages the effort, just by adding citizenship related things.

    It is as equal as what happened in the past, that adding illegal and legal based reform in teh single capsule blowed out everything and no benefit came out finally.

    (Pls note you shd have started your GC process on or before 2000. Then you know the things.
    If you came in 1998 and started GC just 1 or 2 years back..You may not be knowing the reality.)

    I am asking not to waste the energy on useless things.
    Pls concentrate on GC related things which will benefit everybody.

    EB3-I can benefit only if per country cap is removed. Can IV do something to get this done as part of Admin Fix? Otherwise EB3-I will rot in 2001/2002 for next 3 more years.

    did you get yours without CPO mail ? My case is same. No CPO, though got approval/decision emails and approval snail mail.

    I got the CPO email first. In another days 6 days got welcome mail. Then the status changed back to post decision activity. 5 days from there, I got the cards. Even today the status says the same.

    If that is the case you have legitimate reason to take this matter with your local congress man if their legal cannot clear them.
    Follow the suggestions of experts in this thread. I suggest you to contact your local congressmen. They would definitely help as in my case they did to expedite EAD renewal.

    1st H1 valid until Sept 2008.
    Consultate for CP will be Mumbai, India.

    I have a couple of questions pertaining to GC.

    My LC is approved 2 days back (Filed - May 17, Approved - May 25) I didnt know this happens so fast. We have not yet received the cetitified documents from the department so I dont know whether its EB2 or EB3.

    My lawyer says it is upto the department to decide whether my case comes under EB2 or EB3? Is this right?

    Now we plan to file the I-140 in June 07. Should I go for premium processing right from the first time? My company is ready to do this. But someone said on one of these websites that this creates a suspicion in the minds of the department. I dont know how true this is?

    I am thinking to opt for Consular Processing. What do you recommend on this?

    I have read that we can also file I-140/485 concurrently. What does that mean? I was under the impression that first I-140 needs to be approved and only then we can file the other papers.

    I read in one of the posts that the 485 and EAD were approved becore I-140. How is that possible?

    Now the main thing that is bothering me is the financial situation of the company. They have good money and they can afford to pay me well, but the old accountant messed up big time and filed all wrong taxes and di not maintain proper records etc. So on papers its not such a great company, but they have money for sure. How can this be a hurdle?

    All your help will be highly appreciated.

    I knew friends in Kaiser who were hired on H1 and got GC through Kaiser..
    How the hell can they justify filing new GCs, but not accepting EAD!?

    Kaiser stopped hiring on H1 since 2003. They used to hire on EADs until last week.

    Same is the case here.

    Opened a SR on 10Aug2010 and got my CPO mail just today. Although I was very sceptic about following up with USCIS by opening SR etc, now I think it definitely helps. I did not get to speak to an IO or escalate my call to a supervisor, but it still worked. Until I opened SR, nothing was happening and my case status which I was checking 5-6 times a day, remained static with no LUD/HUDs.

    So, my recommendation to all those whose dates are current is to at least open a SR so that someone at USCIS looks at your file. If everything is OK and the case is pre-adjudicated, then approval will come through. Also, my guess is they have already allocated a Visa number for all those cases that are current (reason- Dates did not move too much forward in September Visa Bulletin). Good luck to everyone waiting. I am sure your turn will come very soon, but at least open a SR to expedite it somehow.

    These assumptions marked in red are incorrect. ROW has been consolidated into 1 category to simplify the visa bulletin. ICMP countries exceed the quota, that's why they have separate entries. If another country exceeds the quota U.K. for example, then it'll have it own column in the visa bulletin. The quota for EB-ROW is 40K - per country limit for ICMP for that category X 4. That's why EB3 India has been getting screwed ever since they re-interpreted the spillover rules (in the middle of 2008). Otherwise, you would see EB3 ICMP get at least 8K GCs in 2009.

    1) Each (EB1/2/3) - 28.6% WW quota = 40040
    2) 5 subscription cataegories under each EB category: I,P,C,M,ROW
    ) Assumption - USCIS distributes equal share amon3g these 5 different subscription categories = 40040/5 =8008 in each EB category for a particular subscription category.

    Example:

    EB3 All = 40040 ( 0.286 x 140000)
    EB3 ALL = EB3 I + EB3 C + EB3 M + EB3 P + EB3 ROW

    Assuming equal share of all of these 5 subscription categories - 40040/5 = 8008 applications to be worked for "Assigning the visa number" not " for granting the visa (IN other words physical greencard order)"

    7% + 2% = 9% country specific limit is meant for "Granting the visa - Ordering Physical Green card" out of "Applications which have been assigned a visa number" NOT FOR "Assigning the visa number"
